Debatedores divergem sobre limitação de recursos no novo CPP

Representantes da Defensoria Pública, do Ministério Público e da Ordem dos Advogados do Brasil (OAB) debateram nesta terça-feira (10) a proposta de novo Código de Processo Penal (PL 8045/10 e outros), em audiência pública da comissão especial da Câmara dos Deputados que analisa o tema. Um dos pontos discutidos foi a limitação dos recursos judiciais permitidos à pessoa que é condenada. O recurso é o pedido para que a sentença seja reavaliada.

O secretário-geral adjunto do Conselho Seccional da Ordem dos Advogados do Distrito Federal, Cleber Lopes de Oliveira, disse que é contra diminuir esse tipo de possibilidade porque, segundo ele, cerca de 30% das prisões acabam revertidas em instâncias superiores da Justiça.

“É muito bonito dizer que recursos protelatórios são manejados e que os grandes réus, normalmente os réus ricos, ficam por anos a fio sem cumprir a sua pena. Mas isso pode levar para a prisão inúmeras pessoas que, a posteriori, são declaradas inocentes”, afirmou Oliveira.

O relator do projeto, deputado João Campos (PRB-GO), disse que se preocupa com o assunto. “Há um sentimento hoje, muito mais por parte da sociedade do que dos operadores do Direito, de que o sistema recursal está menos a serviço da ampla defesa e do contraditório e muito mais a serviço da ineficácia da justiça criminal, portanto a serviço da impunidade”, disse o deputado.

“Temos que buscar uma equação, onde a gente esteja de fato protegendo garantias constitucionais, como da ampla defesa e do contraditório e que diz respeito às garantias individuais, mas sem esquecer das garantias da coletividade”, declarou João Campos.
